RULES AND REGULATIONS

GENERAL
These rules and regulations are final on all matters relating to Top Crop Manager’s Cover Photo Contest (the “Contest”). By applying, all entrants agree to be bound by these Rules and Regulations.

HOST
The host (“Host”) of the Contest is Annex Business Media, and its publication, Top Crop Manager magazine (“Top Crop Manager”) (105 Donly Drive South, Simcoe, ON, N3Y 4N5).

SPONSOR
The sponsor (“Contest Sponsor”) of the contest is X (insert address here).

ELIGIBILITY
To be eligible to enter the Contest or win a prize, you must be a permanent resident of Canada. No purchase is necessary to enter the Contest or to win a prize. All photographs entered in the Contest must be of Canadian content (i.e. taken in Canada). Participation in the Contest constitutes Entrants’ full and unconditional agreement to abide by these Contest Rules and Regulations and the Contest Sponsor’s decisions, which are final and binding in all matters related to the Contest.

PERSONAL INFORMATION
Personal Information collected from Entrants by the Host will be used by the Host or its affiliates to administer the Contest and in connection with the publication of winning photographs. Neither the Host/Contest Sponsor nor its affiliates will share personal information relating to Entrants with any third parties, except as necessary for the administration of the Contest or as may be required by law. The Host will not attempt to contact the Entrant for any other purpose than to administer the Contest or as may be required by law unless they have agreed to receive relevant communications from the Contest Sponsor. The Contest Sponsor respects the privacy of everyone who enters the contest.

FORMAT OF PHOTOGRAPHS FOR SUBMISSION
Entries can be submitted electronically through the website of the contest (www.topcropmanager.com/photo-contest) or by email (topcrop@annexweb.com). Submissions made by email must include the entrant’s full name, address, email and contact phone number and a description of your photo to be eligible.

Content alteration of digital files is not acceptable; cropping of photos is permitted, tonal or colour corrections are acceptable, including black and white conversion. Winning entrants must be able to provide a high-resolution version of each photo that they submit (uncompressed TIFF or maximum quality JPEG, Grayscale or Colour (RGB)). Digital files should be at least 1000 pixels tall by 1250 pixels wide (or 8” x 10”) at 300 dpi. For photographs that are selected as winning entries, the high-resolution version of the photograph will be required for reproduction. Entrants who fail to provide a high-resolution version within the time period set by the Contest Sponsors (not to exceed one week following prize notification) will forfeit the prize and an alternate winner will be selected by the judging panel. In such a case, no substitute prizes will be awarded.

USE AND PUBLICATION
By submitting a photo to the contest, the entrant hereby grants Top Crop Manager magazine the right to use photos submitted to the contest. Top Crop Manager magazine will have rights to use images digitally to (a) further expand on the print and digital editions of the magazine; (b) promote Top Crop Manager magazine; and (c) promote Top Crop Manager magazine via Facebook, Twitter, Instagram, Flickr and other social media outlets. By submitting a photo to the contest, the entrant also hereby grants to Top Crop Manager magazine the non-exclusive, perpetual right and license to reproduce, publish and distribute, and to authorize the reproduction, publication and distribution of the photos, in print, on microfilm and microfiche, and in all electronic forms and media now known or later developed, including, but not limited to, on CD-ROM, over the Internet. By uploading a photo to the contest, entrants agree that any such reproduction, publication or distribution may be the work alone and not in conjunction with the works with which it is first published by Top Crop Manager magazine. Top Crop Manager magazine reserves the non-exclusive right to publish any entry and/or use any entry in its material during or after the Contest without further compensation to the entrants. For Top Crop Manager magazine, promotional material shall include without limitation any print or electronic advertising or marketing material such as posters, online images, newspaper ads, television ads, e-mails and social media content.

COPYRIGHT NOTICE

In order that Top Crop Manager magazine can use your photo, you confirm that (a) your photo is your own original work; (b) you own all the rights in the photo, including copyright; (c) you have the right to give Top Crop Manager magazine permission to use your photo for the purposes specified in these rules; (d) the photo is not defamatory and does not infringe any Canadian laws or violate the rights of any third party; (e) you have the consent of anyone who is identifiable in your photo or the consent of their parent / guardian if they are minors; (f) you waive any moral rights that you may have in the photo; (g) you indemnify Top Crop Manager magazine against any claim, demand, action, suit, or other proceedings against Top Crop Manager magazine arising out of the use of the photo or any false or inaccurate statements.

If you do not want to grant Top Crop Manager magazine the permission set out in these rules, please do not submit your photo.

DEADLINES
Contest opens June 3, 2019 and closes at 11:59 PST on October 15, 2019.
All entries become the property of the Host and will not be returned. The Host is not responsible for entries lost, late, misdirected, illegible or delayed for any reason.

JUDGING
A panel of judges selected by Top Crop Manager magazine will pick five photos from all entries received. The team will make its selections considering the following criteria:

1) Photos must clearly exhibit the applicable theme of the contest 
2) The meaning of the photo is reasonably apparent to the audience (i.e. it portrays a clear subject with effect/emotion).
3) Technical quality (i.e. clear and clean composition).
The top photo selected will be published on the cover of a print edition of Top Crop Manager magazine.
The selected winner will be contacted by telephone or email during the week following the judges’ decision and should acknowledge his/her prize as instructed by the Host by no later than three (3) days following the Host’s attempt at contacting the selected winner. If the prize is not claimed within this period, a new winner will be selected.

PRIZES
The winning photo will be featured on the cover of the December 2019 edition of Top Crop manager.

RESPONSIBILITY
The Host is not responsible for any failure of the website during this Contest. Nor is it responsible for any problems or technical malfunctions of computer online systems, servers, access providers, computer equipment, software or any e-mail, online or internet entry lost due to technical problems or traffic congestion on the internet or at any website or any combination thereof, including any injury or damage to an entrant’s or any other person’s computer or property related to or resulting from playing or downloading any material in the promotion.

CHANCES OF WINNING
The chances of winning a prize will depend on the number of eligible photographs received and the evaluation of the photographs by the judging panel.

DISPUTES
By participating in the Contest, each Entrant agrees to be bound by these Contest Rules and Regulations. In the event of any disagreement as to whether a person is an Entrant, a potential winner or a winner, or as to the qualification of any Entrant, potential winner or winner to, or the adequacy of any prize or any substitute prize, the decision of the Host will be final.
